KARACHX, Pakistan, Aug. 9 —The Martial Law Administrator's office in Rawalpindi an flounced today that Sheik Mujibur Rahman, leader of the outlawed Awami League, would be tried by a special military court for “waging war against Pakistan” and other offenses.
The announcement said the trial would begin Wednesday and would be conducted in secret. Gen. Agha Mohammad Yahya Khan, the President of Pakistan, is also the Chief Martial Law Administrator.
Sheik Mujib will be given a chance to prepare his defense and will be provided with all facilities permitted by law, including engaging a lawyer of his own choice, provided that the lawyer is a citizen of Pakistan, the announcement said.
Sheik Mujib, 52 years old, was reported arrested in the early hours of March 26 at his home in Dacca after the Pakistani Army had moved into East Pakistan.
This followed a breakdown of talks between the Pakistani Government, headed by General Yahya and leaders of the Awami League. He was later reported to have been brought to West Pakistan and placed under detention.
[The Associated Press said that Sheik Mujib had been re ported imprisoned at Mianwali, 100 miles southwest of Rawalpindi. The news agency quoted informed sources as saying Sheik Mujib had refused an offer of a lawyer and that he contended that the military tribunal before which he is to appear was “not competent” to judge him.]
The Government announcement did not say where the trial would be held, nor did it identify” the Members of the court.
In a nationwide radio speech on March 26, the Pakistani President accused Sheik Mujib of being a “traitor” who sought the secession of East Pakistan.
The Awami League has 167 out of 313 seats in the national assembly, which makes it the assembly's strongest party. A white paper released last week said that 88 Awami League members who are in the national assembly had kept their seats even after their party was banned. The other 79, the white paper said, would face specific charges of criminal conduct. The assembly has not been convened.
